Change of Deed

(Note: the Americano is unable to sell your unit for you. We are only allowed to sell developer units.)


Dear Owner:

These are instructions how to transfer ownership or delete an owner's name from the deed.

The only way to change ownership or make a correction to a document already of record is to prepare a new document! When submitting a new document it must be submitted along with a Florida Department of Revenue Form. You may obtain one by calling the Recording Department at (386)736-5912 and request that the form be mailed to you.

Please note: Mortgage accounts are not assumable.

If you sell or transfer ownership to another party, a Quit Claim Deed or Warranty Deed will need to be filed and recorded.

Instructions on how to transfer using a Quit Claim Deed or Warranty Deed are as follows:

  1. Blank deeds can be purchased at any office supply store.
  2. All owners must sign exactly as they signed on the Original Warranty Deed.
  3. The signatures must be witnessed by two (2) people other than the owner(s).
  4. The completed document must be notarized by a Notary Public (most representatives at you local banks are Notaries).
  5. The completed document along with the Florida Department of Revenue Form will need to be mailed along with payment for the recording charges to:

  6. The Recording Department will mail you your recorded copy with the Doc Stamp (which lists book and page numbers). After you receive, please mail a copy to:

NOTES

  1. Florida "Transfer of Interest" Form must be completed and signed by the Grantors, Grantees, or their agents. One form must accompany each deed.
  2. The name of each person who executed the instrument must be ligibly printed, typewritten or stamped immediately below the signature.
  3. The name of each witness to the instrument must be legibly printed, typewritten or stamped immediately below their signature. Signatures of two witnesses are required on a deed.
  4. The name of the person who prepared the instrument must be included on the document.
  5. Notary public seal, expiration date, and commission number or corporate seal must be affixed, if applicable.
  6. Include the grantee's mailing address, if transfer or interest is real estate (which a timeshare is - a deed)
  7. Corrective deeds must have a minimum of $.70 in documentary stamps.
  8. Re-recorded (corrections or name changes) instruments must include a statement placed on the first page as to why it is being re-recorded.
  9. Affix the name and address of the person to whom the instrument is to be returned on the front of the instrument or provide us with a self addressed envelope.
  10. Please make sure all mail is addressed to the attention of the Recording Department.
